настоящий Договор о нижеследующем:

2.1. Исполнитель вправе:
2.1.1. Самостоятельно
осуществлять
образовательный
процесс,
устанавливать системы оценок,
формы, порядок и периодичность
проведения
промежуточной
аттестации Слушателя;

hereinafter referred to as "Contractor" represented
by Vice-Rector for Educational Affairs and PreUniversity Education Voronov Artem Anatolyevich,
acting by virtue of Power of Attorney No. 129 dated

hereinafter referred to as the Listener, collectively
referred to as Parties, enter into the contract as
follows:
1.
Предмет договора
1.1. Исполнитель принимает обязательство
оказать
платные
образовательные
услуги (далее Услуги) по обучению
Слушателя, принимающего участие в
мероприятии «Moscow International
Workshop ACM ICPC», по программе
объемом 72 академических часа (в
дальнейшем Программа), а Слушатель
обязуется оплатить образовательные
Услуги в порядке, предусмотренном
настоящим Договором.
1.2. Форма обучения очно-заочная.
1.3. Срок обучения: с «10» ноября 2015 г.
по 21 ноября 2015 г.
1.4. После
прохождения
Слушателем
полного курса обучения по Программе
и успешной итоговой аттестации ему
выдается Сертификат.
2.
Contract № ___________________
for education in additional study programmes
Subject of the Contract
1.1. The Contractor is obliged to provide paid
educational
services
(hereinafter
"Services") in educating the Listener who
participates in the event «Moscow
International Workshop ACM ICPC» in
the programme amounted in 72 academic
hours (hereinafter "Programme") and the
Listener is obliged to pay for the
educational Services in the order
established by this contract.
1.2. The form of study is intra-extramural.
1.3. The studying term starts on 10th
November, 2015 and ends on 21st
November, 2015.
1.4. The Listener will be provided with a
Certificate upon finishing the full
curriculum of the Programme and
successful final academic assessment.
2.
Listener
Rights of the Contractor and the
2.1.
The Contractor has the right to:
2.1.1.
Carry out the educational process
independently, establish a system of grades,
uniforms, the order and periodicity of conduction of
the final academic assessment of the Listener;

соответствии

условиями

2.1.3. По согласованию со Слушателем
вносить
коррективы
в
календарный учебный график и
порядок оказания Услуг по
Договору;
2.1.4. Производить
замену
преподавателя в случае его
болезни
или
других
непредвиденных обстоятельств.
2.2. Слушателю
предоставляются
академические права в соответствии с
частью 1 статьи 34 Федерального
закона от 29 декабря 2012 г. № 273-ФЗ
«Об
образовании
в
Российской
Федерации». Слушатель также в праве:
2.2.1. Получать
информацию
от
Исполнителя
по
вопросам
организации
и
обеспечения
надлежащего
предоставления
услуг,
предусмотренных
разделом 1 настоящего Договора;
2.2.2. Обращаться к исполнителю по
вопросам,
касающимся
образовательного процесса;
2.2.3. Пользоваться
в
порядке,
установленном
локальными
актами,
имуществом
Исполнителя, необходимым для
освоения
дополнительной
профессиональной программы;
2.2.4. Получать полную и достоверную
информацию об оценке своих
знаний, умений, навыков и
компетенций,
а
также
о
критериях этой оценки.
2.1.2.
3.
Обязанности Исполнителя и
Слушателя
3.1. Исполнитель обязан:
3.1.1. Зачислить
Слушателя,
выполнившего
установленные
законодательством Российской
Федерации,
учредительными
документами,
локальными
нормативными
актами
Исполнителя условия приема, в
качестве «Слушателя»;
3.1.2. Довести
до
Слушателя
информацию,
содержащую
сведения
о
предоставлении
платных образовательных услуг
в порядке и объеме, которые
предусмотрены
Законом
Российской
Федерации
«О
защите прав потребителей» и
Федеральным
законом
«Об
образовании
в
Российской
Федерации»;
2.1.2
Demand payment for the Services in
accordance with the conditions of the
Contract;
2.1.3. By agreement with the Listener make
changes to the graphic educational schedule
and the order of provision of Services in
accordance with the Contract;
2.1.4. Substitute professors in case of their illness
or other unexpected situations;
2.2. The Listener is provided with academic rights
in accordance with Part 1 of Article 34 of the
Federal Law dated December 29th, 2012
No.273-FZ (273-ФЗ) On Education in the
Russian Federation.
The Listener has the right to:
2.2.1. Receive information from the
Contractor concerning organization
and security of proper provision of
Services established by Article 1 of
this Contract;
2.2.2. Refer to the Contractor on matters
concerning the educational process;
2.2.3. Use the property of the Contractor
necessary for mastering the
additional professional programme
in the order established by local
acts;
2.2.4. Receive
complete
and
true
information about evaluation of
his/her knowledge, abilities, skills
and competence, as well as the
criteria of such evaluation.
3.
Obligations of the Contractor and
the Listener
3.1.
The Contractor is obliged to:
3.1.1.
Enroll the Listener who fulfilled the
requirements established by the legislation of the
Russian Federation, constituent documents, local
normative acts of the Contractor as the "Listener"";
3.1.2.
Inform the Listener on the details of
provision of paid educational services in the order
and to the extent established by the Law of the
Russian Federation On Consumer Protection and the
Federal Law On Education in the Russian Federation;
3.1.3.
Organize and procure a proper
provision of the educational services established in
Article 1 of this Contract. The educational services
will be provided in accordance with the curriculum
and the academic schedule of the Contractor;
3.1.4.
Keep the place for the Listener in
case he or she misses classes for a valid reason
(taking into account the payment of the Services
provided by Article 1 of this Contract);
3.1.5.
Provide the Listener with a capacity
to use the educational and material base of MIPT;
3.1.6.
Accept the payment for educational
Services executed by the Listener.
3.1.3.
Организовать
и
обеспечить
надлежащее исполнение Услуг, предусмотренных
в разделе 1 настоящего Договора в соответствии с
учебным планом и расписанием занятий
Исполнителя;
3.1.4.
Сохранить место за Слушателем в
случае пропуска занятий по уважительным
причинам
(с
учетом
оплаты
Услуг,
предусмотренных
разделом
1
настоящего
Договора);
3.1.5.
Предоставить
Слушателю
возможность пользоваться учебно-материальной
базой МФТИ;
3.1.6.
Принимать от Слушателя плату за
образовательные Услуги.
3.2.
Слушатель обязан соблюдать
требования,
установленные
в
статье
43
Федерального закона от 29 декабря 2012 г. № 273ФЗ «Об образовании в Российской Федерации», в
том числе:
3.2.1.
Выполнять
задания
для
подготовки
к
занятиям,
предусмотренным
учебным планом;
3.2.2.
Извещать
Исполнителя
о
причинах отсутствия на занятиях;
3.2.3.
Обучаться по образовательной
программе с соблюдением учебного плана
Исполнителя;
3.2.4.
Соблюдать
требования
учредительных документов, правила внутреннего
распорядка и иные локальные нормативные акты
Исполнителя;
3.2.5.
Своевременно вносить плату за
предоставляемые Слушателю образовательные
Услуги, указанные в Договоре, в размере и
порядке, определенных настоящим Договором, а
также предоставлять платежные документы,
подтверждающие такую оплату.
4. Стоимость услуг и порядок расчетов
4.1. Полная
стоимость
платных
образовательных услуг за весь период
обучения Слушателя составляет 375
(триста семьдесят пять) долларов США
(не облагается НДС на основании пп. 14
п. 2 ст. 149 Налогового кодекса РФ).
4.2. Оплата производится единовременно и
время оплаты не позднее 09 ноября
2015г года в безналичном порядке на
счет, указанный в разделе 9 настоящего
Договора.
5.
Основания изменения и расторжения
договора
5.1. Условия,
на
которых
заключен
настоящий Договор, могут быть
изменены по соглашению Сторон или в
соответствии
с
законодательством
Российской Федерации.
5.2. Настоящий Договор может быть
расторгнут по соглашению Сторон.
3.2.
The Listener is obliged to comply
with the requirements established in Article 43 of the
Federal Law dated December 29th, 2012 No. 273-FZ
(273-ФЗ) On Education in the Russian Federation,
including the follows:
3.2.1.
Do the homework established by the
curriculum as preparation for the classes;
3.2.2.
Inform the Contractor on the reasons
of absence in the classes;
3.2.3.
Study in accordance with the study
programme and comply with the curriculum of the
Contractor;;
3.2.4.
Comply with the requirements of the
constituent documents, internal rules of conduct and
other local and normative acts of the Contractor.
3.2.5.
Pay for the educational Services
provided to the Listener and specified in the Contract
in due time and in the amount and order defined by the
Contract, as well as provide billing documents
confirming such a payment;
4.
Cost of the Services and Payment
Order
4.1.
The full cost of paid educational
services during the whole period of studying of the
Listener is $375 (three hundred seventy-five) (the cost
is not subject to the Value Added Tax based on SubItem 14 Item 2 Article 149 of the Tax Code of the
Russian Federation).
4.2.
Payment shall be executed in the
one-time manner on or before November 09th, 2015 in
the form of cashless transfer to the account specified
in the Article 9 of this Contract.
5.
Grounds for
Termination of the Contract
Changing
and
5.1.
The terms and conditions on which
the Contract was concluded may be subject to changes
by agreement between the Parties or in accordance
with the legislation of the Russian Federation.
5.2.
This Contract may be terminated on
agreement by the Parties. программы;
5.3. This Contract may be terminated by the
Contractor in unilateral manner in the
following cases:
finding of breaking the order of enrolment
in the educational institution that resulted in
unlawful enrolment in this educational
institution due to the fault of the Listener;
delay in payment for the educational services;
impossibility of proper performance of obligation for provision
of the paid Services in case of action (inaction) of the Listener;
other cases provided by the Legislation of the
Russian Federation
5.4. Early termination of the Contract shall take place:
by the Contractor in case of expel of the
Listener as a measure of disciplinary
sanction, in case the Listener fails to fulfill
the obligations in dutiful education on the
professional programme and comply
5.5. Настоящий Договор может быть
расторгнут по инициативе Исполнителя
в одностороннем порядке в случаях:
установления нарушения порядка приема
в
образовательную
организацию,
повлекшего по вине Слушателя его
незаконное
зачисление
в
эту
образовательную организацию;
просрочки оплаты стоимости платных
образовательных услуг;
невозможности надлежащего исполнения
обязательства
по
оказанию
платных
образовательных услуг вследствие действий
(бездействия) Слушателя;
в иных случаях, предусмотренных
законодательством Российской Федерации.
5.6. Настоящий
Договор
расторгается
досрочно:
по инициативе Исполнителя в случае
применения к Слушателю отчисления как
меры дисциплинарного взыскания, в случае
невыполнения
обучающимся
по
профессиональной
образовательной
программе
обязанностей
по
добросовестному
освоению
такой
образовательной программы и выполнению
учебного плана, а также в случае нарушения
порядка
приема
в
образовательную
организацию,
повлекшего
по
вине
обучающегося его незаконное зачисление в
образовательную организацию;
по обстоятельствам, не зависящим от
воли Слушателя и Исполнителя, в том числе
ликвидации Исполнителя.
5.7. Слушатель вправе отказаться от
исполнения настоящего Договора при
условии
оплаты
Исполнителю
фактически понесенных им расходов,
связанных с исполнением обязательств
по Договору.
6.
Ответственность Исполнителя,
Слушателя
6.1. За неисполнение или ненадлежащее
исполнение своих обязательств по
Договору
Стороны
несут
ответственность,
предусмотренную
законодательством
Российской
Федерации и настоящим Договором.
7.
Срок действия Договора
7.1. Настоящий Договор вступает в силу со
дня его заключения Сторонами и
действует до полного исполнения
Сторонами обязательств.

breaking the order of enrolment in the
educational institution that resulted in
unlawful enrolment in this educational
institution due to the fault of the Listener,
by circumstances that are beyond the
reasonable control of the Listener and the Contractor,
including liquidation of the Contractor.
1.1. The Listener has the right to repudiate this
Contract providing that the payment for the
expenses incurred by the Contractor caused
by execution of obligations in accordance
with the Contract is carried out.
6.
Responsibility of the Contractor and
the Listener
6.1. The Parties are responsible for non-fulfillment
and improper fulfillment of their obligations under the
Contract according to the legislation of the Russian
Federation and the Contract.
7.
Term of the Contract
7.1. This Contract shall come into force when signed
shall be valid till fulfillment of the obligations by
both Parties.
8.
Final clauses
8.1. The Listener hereby agrees that the Contractor
shall collect, process, store and disclose the
Listener's personal data specified in the Contract
in accordance with the Federal Law dated
27.07.2006 No. 152-FZ (152-ФЗ) On personal
Data for processing by automatic and manual
means with the purpose of solving the problems
relating to the provision of the educational
Services to the Listener. This agreement shall be
valid during the period of studying and storage of
the personal record and it can be recalled at any
moment by a personal statement of the Listener.
8.2. The details specified in this Contract correspond
with the information submitted on the official
internet website of the Contractor as of the date of
conclusion of this Contract.
8.3. A copy of the Listener's degree is attached to the
Contract in case if the document is exist.
8.4. This Contract is executed in two original copies,
one for each Party. Both copies have the same
legislative power. All alterations and amendments
to the Contract shall be made in writing in form of
an additional agreement to the Contract.
8.5. Alterations to this Contract shall be executed in
the form of an additional agreements to the
Contract.
8.
Заключительные положения
8.1. Слушатель выражает свое согласие
Исполнителю на сбор, обработку,
хранение
и
передачу
своих
персональных данных, указанных в
настоящем Договоре в соответствии с
Федеральным законом от 27.07.2006г. №
152-ФЗ «О персональных данных»,
путём обработки, автоматизированным
и неавтоматизированным способами в
целях осуществления основных видов
деятельности Исполнителя. Настоящее
согласие действует в течение периода
обучения и хранения личного дела
Слушателя и может быть отозвано в
любое время по личному заявлению
Слушателя.
8.2. Сведения, указанные в настоящем
Договоре, соответствуют информации,
размещенной на официальном сайте
Исполнителя в сети «Интернет» на дату
заключения настоящего Договора.
8.3. К Договору прилагается копия диплома
об образовании Слушателя, в случае
наличия данного документа.
8.4. Настоящий Договор составлен в 2-х
экземплярах, по одному для каждой из
Сторон.
Оба
экземпляра
имеют
одинаковую
юридическую
силу.
Изменения и дополнения настоящего
Договора могут производиться только в
письменной форме и подписываться
Сторонами.
8.5. Изменения Договора оформляются
дополнительными соглашениями к
Договору.
