Михайловича, действующего на основании
Устава, именуемое в дальнейшем Исполнитель,
с одной стороны, и

именуемый (ая) в дальнейшем Заказчик,
заключили
настоящий
договор
о
нижеследующем:
1. ПРЕДМЕТ ДОГОВОРА
1.1. По настоящему договору Исполнитель
принимает на себя обязательства по оказанию
Заказчику
платных
дополнительных
образовательных услуг (далее Услуги) по
следующим видам и объему: практический курс
«Русский язык как иностранный», 560 часов,
практический курс «Математика» 120 часов,
практический курс «Обществознание», 120
часов, а Заказчик обязуется оплатить оказанные
Услуги.
1.2. Исполнитель предоставляет Услуги согласно
установленному расписанию в срок: с 17.11.2014
по 31.07.2015.
1.3. Исполнитель осуществляет образовательную
деятельность на основании лицензии серия ААА
№ 002378 от 27.09.2011 г., Положения ТГУ о
платных дополнительных образовательных и
иных
услугах,
Положения
о
Центре
коммуникации, приказ № 1151 от 27.03.2012
2. СТОИМОСТЬ УСЛУГ И ПОРЯДОК
ОПЛАТЫ
2.1. Стоимость оказываемых Заказчику Услуг
определяется
по
соглашению
сторон в
соответствии со сметой расходов.
2.2. Стоимость Услуг по настоящему договору
составляет: 59 500 (пятьдесят девять тысяч
пятьсот) рублей, включая НДС 9076 (девять
тысяч семьдесят шесть) рублей 27 (двадцать
семь) копеек.
2.3. Порядок оплаты определяется в соответствии
с Положением о платных дополнительных
образовательных и иных услугах ТГУ, приказом
ректора и условиями настоящего договора.
2.4. Оплата за предоставляемые Услуги
производится через учреждения банков на
расчетный
счет
Исполнителя
или
непосредственно в кассу ТГУ: первый взнос (не
менее 10% от стоимости договора) в течение 3
(трех) рабочих дней с начала программы,

90A01 0000441 issued on March 11, 2013), in the person
of the Rector Mikhail M. Krishtal, acting by virtue of
Charter, hereafter referred to as “Contractor”, from one
side,
and

hereafter referred to as “Client”, from the other side, have
concluded the present Agreement on the following:
1. SUBJECT OF THE AGREEMENT
1.1.
According to the present Agreement the
Contractor undertakes to provide the Client with the
following supplemental educational services on the
payment basis (hereafter referred to as “Services”):
practical course "Russian as a foreign language", 560
hours, practical course "Mathematics" 120 hours
practical course "Social studies", 120 hours, and the
Client undertakes to make payment for the Services
provided.
1.2.
The Contractor provides the Services according
to the established schedule within the following terms:
from November 17, 2014 to July 31, 2015.
1.3.
The Contractor conducts educational activity
according to the Licence No. AAA 002378 issued on
September 27, 2011, the Regulations of TSU for PaymentBased Supplemental Educational and Other Services, the
Regulations for the Center of Communication, order No.
1151 issued on March 27, 2012.
2.
COSTS AND PAYMENT PROCEDURE
2.1.
The cost of the services rendered to the Client is
calculated by agreement of the parties according to the
estimate of expenditure.
2.2.
The cost of the Services under the Agreement is
59 500 RUR (fifty nine thousand five hundred rubles)
including VAT 9076 RUR (nine thousand seventy-six)
rubles, 27 (twenty seven) kopecks.
2.3.
The payment procedure is determined in
accordance with the Regulations of TSU for PaymentBased Supplemental and Other Services, the rector’s order
and terms of the present Agreement.
2.4.
The payment for the rendered Services shall be
made by transferring the money to the Contractor’s bank
account or by direct payment made in the payment office
of Togliatti State University. The payment shall be made
in rubles according to the exchange rate of Central Bank
of the Russian Federation on the day of payment and shall
be divided into parts: the first payment (no less than

2.5. Фактом оплаты за подготовку является
поступление денежных средств на расчетный
счет университета.
3. ПРАВА И ОБЯЗАННОСТИ СТОРОН
3.1. Права и обязанности сторон определяются
Уставом
университета,
приказами
и
распоряжениями ректора, решениями Ученого
Совета, действующим законодательством РФ и
условиями настоящего договора.
3.2. Исполнитель вправе расторгнуть договор в
одностороннем порядке в случаях:
- не соблюдения Заказчиком сроков оплаты в
соответствии с п. 2.4 настоящего договора;
- грубых нарушений Заказчиком правил
внутреннего распорядка ТГУ.
3.3. Исполнитель обязан:
- оказать Услуги с надлежащим качеством, в
полном объеме и в срок согласно настоящему
договору;
обеспечить
обучение
Заказчика
по
утвержденным учебным планам и программам в
соответствии
с
государственными
образовательными стандартами (программами
дополнительного
профессионального
образования, авторскими курсами и т.п.),
заданиями для контрольно-самостоятельной
работы;
- обеспечить визовую поддержку, включающую в
себя официальное приглашение и почтовые
услуги;
- создать условия для предоставления Услуг, с
учетом требований по охране труда;
- при условии выполнения Заказчиком всех
требований по настоящему договору, при
успешной
аттестации
выдать
Заказчику
сертификат об окончании курсов.
З.4. Заказчик имеет право:
- требовать получение Услуг в полном объеме и
надлежащего качества;
- на расторжение настоящего договора в
одностороннем порядке.
3.5. Заказчик обязан:
- выполнять правила внутреннего распорядка
ТГУ;
- в установленные сроки выполнять все виды
учебных заданий, предусмотренных учебными
планами и программой обучения;
- производить оплату образовательных Услуг по
цене и в срок, предусмотренным настоящим
договором.
4. ОТВЕТСТВЕННОСТЬ СТОРОН
4.1. За невыполнение либо ненадлежащее
выполнение своих обязательств по настоящему
договору стороны несут ответственность,
предусмотренную
действующим
законодательством.
5. ЗАКЛЮЧИТЕЛЬНЫЕ УСЛОВИЯ
5.1. Договор вступает в силу с момента его

2.5.

3. RIGHTS AND OBLIGATIONS OF THE
PARTIES
3.1
Rights and obligations of the parties are set
according to the virtue of Charter of the University,
rector’s orders, decrees of the Academic Board, legislation
of the Russian Federation and terms of the present
Agreement.
3.2
The Contractor has a right to terminate the
Agreement at its sole discretion in the following cases:
should the Client does not follow the terms of
payment under clause 2.4. of the present Agreement;
should the Client violently breaks the rules of the
internal order of TSU.
3.3 The Contractor is obliged:

to render the Services of the proper quality in full
volume and within the terms according to the present
Agreement;

to provide the Client with the training according
to the established curriculum and study programs in
compliance with the state educational standards (programs
of supplemental professional training, self-designed
courses, etc.) and assignment for independent study;

to provide visa support to the Client which
includes official invitation and regular postal services;

to render the Services under the conditions that
meet health and safety requirements;

to issue a certificate upon successful completion
of the course, if the Client followed all terms of the
Agreement.
3.4 The Client has a right:

to demand the Services to be provided of the
proper quality and in full volume;

to terminate the present Agreement at its sole
discretion.
3.5 The Client is obliged:

to follow the rules of the internal order of TSU;

to do learning assignments, specified in the
studying programs and curriculum in due time;

to make payments for the educational Services at
the price and within the terms stipulated in the present
Agreement.
4. LIABILITY OF THE PARTIES
4.1
In case of the failure to carry out the obligations
or their improper fulfillment the Parties shall bear
responsibility under the present Agreement in accordance
with legislation.
5.1
5. FINAL PROVISIONS
The Agreement shall enter into force on the date

5.2. Договор может быть изменен или расторгнут
по письменному соглашению всех сторон, а
также в случаях, предусмотренных п.п. 3.2; 3.4.
настоящего договора.
5.3. При досрочном расторжении договора,
сумма произведенной оплаты возвращается
Заказчику за вычетом стоимости оказанных
Услуг.
5.4. О намерениях расторгнуть договор стороны
предупреждают друг друга за один месяц.
5.5. Споры и разногласия по настоящему
договору, не разрешенные путем переговоров,
рассматриваются в судебном порядке.
5.6. Настоящий договор составлен в двух
экземплярах,
имеющих
одинаковую
юридическую силу, по одному для каждой из
сторон.

parties are fulfilled.
5.2
The present Agreement may be modified or
terminated according to the written agreement of the
parties and in cases stipulated in the clauses 3.2 and 3.4 of
the present Agreement.
5.3
In case of premature termination of the
Agreement, the paid money will be refunded to the Client
minus expenses for the rendered Services.
5.4
The present Agreement may be cancelled by
either of the two parties with one month notice.
5.5
The disputes and disagreements arose from the
Agreement shall be settled in court, if no agreement can
be reached in a friendly manner.
5.6
The present agreement was drawn up drawn up in
two copies being equally authentic, in the Russian and
English languages, one for each Party.
