Further liberalization of judicial-legal system is a priority task of democratic renewal of the country Komron Nigmatov, Chief counselor of Research centre under the Supreme court of Republic Uzbekistan Журнал «Демократлаштириш ва инсон ҳуқуқлари» (2012, №1) The Republic of Uzbekistan since the first days of its independence has started creating a normative-legal base that meets present requirements of international law, directed at ensuring strict observance of the rights and legitimate interests of persons in criminal procedure. Adoption of the Constitution of the Republic of Uzbekistan and securing in it whole set of rights and freedom of the person has become the first step in this direction. At Constitution level a principle according to which a human being, his life, freedom, honor, dignity and his other inalienable rights are of supreme value has been fixed. Today Uzbekistan is the participant more than 60 international legal agreements in the field of protection of human rights, the considerable part of them touch upon the question of justice delivery process. For the implementation of provision of the Constitution the state has been carrying out drastic reforms in the various spheres of law, including criminal procedure. A reform being carried out in the country on humanization of a criminal policy and the realization of the principle of free all-around development of the human personality has entailed liberalization of the criminal procedure legislation, in particular, and in sphere of criminal procedure coercion. One of the manifestations of the formation of a civil society, the protection of the human rights and freedom and the further democratization of judicial-legal system is the initiative of the President of the Republic of Uzbekistan of I.A.Karimov on the realization of a complex organizational and legal measures directed at the effective resolution of the tasks in the Concept of the further deepening of democratic reforms and formation of a civil society in the country from November, 12th, 2010. It is difficult to imagine the realization of a legal reform without the further improvement of the legislation aimed at expanding freedom and legitimate rights of participants of criminal procedure, the further reforming of judicial-legal system and improvement of a normative-legal base in our country. For the purpose of the realization of the tasks in the Concept, in the country there is being carried out large-scale analytical work by leading scientists and lawyers and practitioners on -2- preparing a draft law, in light of foreign experience study on the democratization of criminal procedure legislation. Logic continuation of the realization of the international standards in the field of ensuring human rights and freedoms in criminal procedure are the relevant norms of the national legislation regulating the application of measures of procedural coercion. Thus, 29 and 31 chapters of the Criminal Procedure Code of the Republic of Uzbekistan has provided for legal bases, as well as features of application of such procedural coercion as removal from the post and sending a person to medical institution. At present measures of procedural coercion in the form of removal from the post and sending a person to medical institution are applied by inquiry and preliminary investigation bodies, and supervision over their legality and validity is being carried out by the Public Prosecutor office bodies. According to the norms of international law and the article 19 of the Basic law of the Republic of Uzbekistan, the rights and freedoms of citizens secured in the Constitution and laws, are firm, and can be limited or deprived only by the court possessing the attributes such as fair, independence and impartiality. So, the draft law, developed by the authorized and interested ministries and departments in accordance with the Concept, provides for the consideration and the appeal of the petition for the removal from the post and sending of accused and convicted to a medical institution is similar to the procedure of consideration and appeal of the decision on the application of a restrain measure in the form of custody. Now, an inquiry officer, an investigator, a public prosecutor or court have the right to remove an accused, a defendant from the post if there are sufficient bases to believe, that, remaining at former work, he will interfere with the establishment of truth in a criminal case, the compensation of damage caused by a crime, or continue his criminal activity. In pursuance of an article 257 of the Criminal procedure code of the Republic of Uzbekistan, a resolution or a decision on removing an accused, a defendant from the post is cancelled by an inquiry officer, an investigator, a public prosecutor, a court when the further necessity of the application of this measure falls away. The international experience study has shown that the measure of procedural coercion in the form of removal from the post in Armenia is carried out by a public prosecutor without the permission of court, and on the instructions of a public prosecutor, by an inquiry and an investigation body. However the given measure -2- -3- can be cancelled by a court if the necessity falls away. In Azerbaijan the procedural coercion in the form of removal from the post can be applied only by a court based on the filing of a public prosecutor. In Byelorussia and Kazakhstan the given procedural coercion is applied both by a public prosecutor, deputy prosecutor, and a body of inquiry and an investigator with a sanction of a public prosecutor or deputy prosecutor, and a court. In Moldova it is applied by a public prosecutor without the permission of a court. However the given decision can be appealed at the court of law. In legislations of foreign countries, for example in Japan and France the measure of procedural coercion in the form of removal from the post is not provided for. Besides, the analysis of international experience concerning sending of a person to a medical institution has shown that sending of a person, not in custody, to a medical institution (for conducting of forensic medical examination or forensic psychiatry examination) under the legislation of Russia is not considered as a measure of procedural coercion, and is carried out only according to the court’s decision based on the petition of an investigator agreed with a public prosecutor. In Ukraine sending a person to a medical institution is not considered as a type of a procedural coercion, and is carried out by a court based on the filing of an investigator agreed with a public prosecutor. In Armenia and Azerbaijan sending of a person to a medical institution as a type of procedural coercion measure is carried out only on the basis of a court decision. In Moldova sending a person to a medical institution is not considered as a type of a procedural coercion measure, and is allowed based on the sanction of a judge upon the petition of a public prosecutor. In Byelorussia sending a person to a medical institution is not considered as a type of a procedural coercion either and in relation to persons not being kept in custody, is carried out upon the decision of an investigator, a body of inquiry with the sanction of a public prosecutor or his deputy. If the question on the necessity of instituting a forensic medical examination or a forensic psychiatry examination and sending a person to a medical institution arises during the sitting of the court, the decision on that question is made by the court upon the petition of the parties or upon its own initiative, about which it adopts a decision. In the legislation of the USA compulsory psychiatric examination of an accused is carried out upon the petition of a public prosecutor with the order of the court about sending of an accused to an examination. Application of a procedural coercion -3- -4- measure in the form of sending a person to a medical institution in the legislations of Japan, France and Germany has not been noted. Transfer of the right of application of certain measures of procedural coercion measures to courts, such as, removal from the post, sendinf a person to a medical institution will allow: to consistently continue the reforms on ensuring the judicial control over the inquiry and the preliminary investigation, the beginning of which was the transfer of the right of issuing a sanction on the imprisonment to courts; to strengthen the judicial control over the inquiry and preliminary investigation and to expand the sphere of application of institute «Habeas corpus» in criminal procedure; to ensure the application of the measures related to the restriction of such constitutional rights of citizens, as the right to freedom and inviolability of person, only by the body possessing the attributes such as independence, objectivity and impartiality; to ensure the realization of the universally accepted principles and norms of international law in the field of protection of the rights and freedom of citizens, and also the articles 19 of the Constitution of the Republic of Uzbekistan, according to which the rights and freedom of citizens secured in the Constitution and laws, are firm and no one except the court has the right to deprive them of or limit them. Other priority direction of democratization of the criminal procedural legislation is the realization of a principle of adversary proceeding («equality of arms») in the criminal procedure, which presupposes the equal rights and the participation of the defense and prosecution in the sitting of the court. In the current legislation the obligation of the state prosecutor on reading out the bill of particulars in judicial sitting is not clearly defined. In this connection the bill of particulars is quite often read out by judges, which does not correspond to the purposes and as a whole to the mission of the court. Introducing into the criminal procedural legislation a norm obliging a public prosecutor to read out the bill of particulars, will promote the maintenance of independence, objectivity and impartiality of the court, and also the strengthening of the principle, according to which prosecution and defense will have equal opportunities to search truth and to uphold their statements or contest the statements of other party. Thus, the creation of an effective mechanism obliging the state prosecution to participate in the consideration of criminal case at court of the first instance and him to read out the bill of particulars will ensure the realization of a principle of -4- -5- equality of arms, the effective performance by the public prosecutor of his basic function to maintain the state prosecution in trial. In addition to that, in the Concept it has been mentioned the expediency of an exclusion from the article 321 of the Criminal procedural code of the Republic of Uzbekistan the authority of court in accordance with which it has the right to file a criminal case. It is well known that instigating a criminal case is, first of all, the duty of agencies of inquiry and pretrial investigation, other law-enforcement agencies that carry out criminal prosecution. Meanwhile, the court is required to fairly assess observance of law and reasonableness of charges brought against a person. At the same time, filing a criminal case by court, i.e. exercising a procedural act by it, which in fact means the start of criminal prosecution with all relevant consequences, makes the court a participant of this prosecution. For the purpose of avoiding the transformation of the court into the body of criminal prosecution and concentrating it on its primary goal such as justice delivery, it will be fair to exclude of the court from the obligation to file a criminal case in all cases when there are reasons and sufficient bases for that. In conclusion, it would be desirable to specially note that the judicial and legal reforms being realized in the country directed towards the democratization and liberalization of the criminal procedural legislation should keep step with the general level of legal education of our people. Therefore, it is important to create targeted and comprehensive program of measures to radically improve the legal education and enlightenment in the country, as well as propaganda of legal knowledge in the society. The implementation of this program should nurture a respective attitude of people to human rights and freedoms, and ensure education of citizens in the spirit of observance of the Constitution and the law of the Republic of Uzbekistan. -5- -6- Дальнейшая либерализация судебно-правовой системы – приоритетная задача демократического обновления страны К.Нигматов, главный консультант Исследовательского центра при Верховном суде Республики Узбекистан Республика Узбекистан с первых дней независимости приступила к созданию отвечающей современным требованиям международного права нормативно-правовой базы, направленной на обеспечение неукоснительного соблюдения прав и законных интересов лиц в уголовном процессе. Первым шагом в этом направлении стало принятие Конституции Республики Узбекистан и закрепление в ней всего комплекса прав и свобод человека. На уровне Конституции закреплен принцип, в соответствии с которым высший ценностью является человек, его жизнь, свобода, честь, достоинство и другие неотъемлемые права. На сегодняшний день Узбекистан является участником более 60 международно-правовых соглашений в области защиты прав человека, значительная часть из них затрагивает процесс осуществления правосудия. Для реализации положений Конституции государство проводит радикальные преобразования в различных отраслях права, в том числе в области уголовного судопроизводства. Осуществляемая в стране реформа по гуманизации уголовной политики и реализация принципа свободного всестороннего развития человеческой личности повлекла либерализацию уголовнопроцессуального законодательства, в частности, и в сфере уголовнопроцессуального принуждения. Одним из проявлений по формированию гражданского общества, защиты прав и свобод человека и дальнейшей демократизации судебно-правовой системы является инициатива Президента Республики Узбекистан И.А.Каримова о реализации комплекса организационно-правовых мер направленных на эффективное решение поставленных задач в Концепции дальнейшего углубления демократических реформ и формирования гражданского общества в стране от 12 ноября 2010 года. Трудно представить реализацию правовой реформы без дальнейшего совершенствования законодательства, нацеленного на расширение свобод и законных прав участников уголовного процесса, дальнейшее реформирование судебно-правовой системы и совершенствование нормативно-правовой базы в нашей стране. В целях реализации задач, изложенных в Концепции, в стране ведется широкомасштабная аналитическая работа ведущими учеными-правоведами и практиками по подготовке законопроекта, с учетом изучения зарубежного опыта, касающегося демократизации уголовно-процессуального законодательства. Логическим продолжением реализации международных стандартов в области обеспечения прав и свобод лиц в уголовном процессе являются соответствующие нормы национального законодательства, регулирующие -6- -7- применение мер процессуального принуждения. Так, в 29 и 31 главах Уголовно-процессуального кодекса Республики Узбекистан, предусмотрены правовые основы, а также особенности применения таких мер процессуального принуждения, как отстранение от должности и помещение лица в медицинское учреждение. В настоящее время меры процессуального принуждения в виде отстранения от должности и помещения в медицинское учреждение применяются органом дознания и предварительного следствия, и надзор за их законностью и обоснованностью осуществляется органами прокуратуры. В соответствии с нормами международного права и статьей 19 Основного закона Республики Узбекистан права и свободы граждан, закрепленные в Конституции и законах, являются незыблемыми, и могут быть ограничены или лишены только судом, обладающим атрибутами справедливости, независимости и беспристрастности. Так, проектом, разработанного с уполномоченными и заинтересованными министерствами и ведомствами в соответствии с Концепцией, предусматривается рассмотрение и обжалование ходатайства об отстранении от должности и помещении обвиняемого, подсудимого в медицинское учреждение аналогично порядку рассмотрения и обжалования определения о применении меры пресечения в виде заключения под стражу. В настоящее время, дознаватель, следователь, прокурор или суд вправе отстранить обвиняемого, подсудимого от должности, если есть достаточные основания полагать, что, оставаясь на прежней работе, он будет препятствовать установлению истины по уголовному делу, возмещению ущерба, причиненного преступлением, или продолжать преступную деятельность. В силу статьи 257 Уголовно-процессуального кодекса Республики Узбекистан, постановление или определение об отстранении обвиняемого, подсудимого от должности отменяется дознавателем, следователем, прокурором, судом, когда в применении этой меры отпадает дальнейшая необходимость. Изучение международного опыта показало, что мера процессуального принуждения в виде отстранения от должности в Армении производится прокурором без разрешения суда, а также, по поручению прокурора, органом дознания и следствия. Однако данная мера может быть отменена судом, если в нем отпадает необходимость. В Азербайджане мера пресечения в виде отстранения от должности может применяться только судом по представлению прокурора. В Республике Беларусь и Казахстане данная мера пресечения применяется как прокурором, его заместителем, а также органом дознания и следователем с санкции прокурора или его заместителя, так и судом. В Молдове она применяется прокурором без разрешения суда. Однако данное решение может быть обжаловано в суде. В законодательствах зарубежных стран, например Японии и Франции мера процессуального принуждения в виде отстранения от должности не предусмотрена. Кроме того, анализ международного опыта касательно помещения лица в медицинское учреждение выявил, что помещение лица, не находящегося -7- -8- под стражей, в медицинское учреждение (для производства судебномедицинской или судебно-психиатрической экспертизы) по законодательству России не является мерой процессуального принуждения, и производится только согласно решению суда по ходатайству следователя согласованного с прокурором. На Украине помещение лица в медицинское учреждение не является видом меры принуждения, а осуществляется судом по представлению следователя, согласованного с прокурором. В Армении и Азербайджане помещение лица в медицинское учреждение в качестве вида меры принуждения производится только на основании решения суда. В Молдове помещение лица в медицинское учреждение не является видом меры принуждения, и допускается с санкции судьи на основании ходатайства прокурора. В Республике Беларусь помещение лица в медицинское учреждение не является видом меры принуждения и в отношении лиц, не содержащихся под стражей, производится по постановлению следователя, органа дознания с санкции прокурора или его заместителя. Если вопрос о необходимости назначения судебно-медицинской или судебнопсихиатрической экспертизы и помещения подсудимого в государственное медицинское учреждение возникает в судебном заседании, то решение об этом принимает суд по ходатайству сторон или по собственной инициативе, о чем выносится определение. В законодательстве США принудительная психиатрическая экспертиза обвиняемого производится по ходатайству прокурора приказом суда о направлении обвиняемого на экспертизу. Применение меры процессуального принуждения в виде помещения лица в медицинское учреждение в законодательствах Японии, Франции и Германии не наблюдается. Передача судам права применения отдельных мер процессуального принуждения, таких как, отстранение от должности, помещение лица в медицинское учреждение позволит: а) последовательно продолжить реформы по обеспечению судебного контроля над дознанием и предварительным следствием, началом которой была передача судам права выдачи санкции на заключение под стражу; б) усилить судебный контроль при производстве дознания и предварительного следствия, расширить сферу применения института «Хабеас корпус» в уголовном процессе; в) обеспечить применение мер, связанных с ограничением таких конституционных прав граждан, как право на свободу и личную неприкосновенность, только органом, обладающим атрибутами независимости, объективности и беспристрастности; г) обеспечить реализацию общепризнанных принципов и норм международного права в области защиты прав и свобод граждан, а также статьи 19 Конституции Республики Узбекистан, согласно которой права и свободы граждан, закрепленные в Конституции и законах, являются незыблемыми и никто не вправе без суда лишить или ограничить их. Другим приоритетным направлением демократизации уголовнопроцессуального законодательства является реализация принципа состязательности сторон в уголовном процессе, предполагающего равные права и участие сторон защиты и обвинения в судебном заседании. В -8- -9- действующем законодательстве обязанность государственного обвинителя по оглашению обвинительного заключения в судебном заседании четко не определена. В связи с этим обвинительное заключение нередко оглашается судьями, что не соответствует целям и в целом предназначению суда. Внесение в уголовно-процессуальное законодательство нормы, обязывающей оглашение обвинительного заключения прокурором, будет способствовать обеспечению независимости, объективности и беспристрастности суда, а также усилению принципа, согласно которому обвинение и защита будут иметь равные возможности для отыскания истины и отстаивания своих утверждений либо оспаривания утверждений другой стороны. Таким образом, создание действенного механизма, обязывающего государственного обвинителя участвовать при рассмотрении уголовного дела в суде первой инстанции и самому оглашать обвинительное заключение обеспечит реализацию принципа состязательности сторон, эффективное выполнение прокурором возложенной на него основной функции по поддержанию государственного обвинения в судебном разбирательстве. Кроме всего, в Концепции указывается о целесообразности исключения из статьи 321 Уголовно-процессуального кодекса Республики Узбекистан полномочия суда, в соответствии с которым он обладает правом возбуждать уголовное дело. Как известно, возбуждение уголовного дела является задачей, прежде всего органов дознания и предварительного следствия. При этом от суда требуется объективно оценить законность и обоснованность предъявленного лицу обвинения. В то же время, возбуждение судом уголовного дела, то есть совершение им процессуального действия, которое, по сути, является началом уголовного преследования со всеми вытекающими отсюда юридическими последствиями, переводит суд в категорию участников этого преследования. В целях предотвращения превращения суда в орган уголовного преследования и сосредоточения его на основной задаче, как отправление правосудия справедливым является исключение обязанности суда возбуждать уголовное дело во всех случаях, когда к тому имеются поводы и достаточные основания. В заключении хотелось бы особо отметить, что реализуемые в стране судебно-правовые реформы направленные на демократизацию и либерализацию уголовно-процессуального законодательства должны идти в ногу с общим уровнем юридического просвещения нашего народа. Поэтому важно обеспечить создание целевой комплексной программы мер, направленной на кардинальное улучшение правового образования и просвещения в стране, пропаганды правовых знаний в обществе. Реализация этой программы должна обеспечить формирование у населения уважительного отношения к правам и свободам человека, а также воспитание граждан в духе соблюдения Конституции и законов Республики Узбекистан. -9- - 10 - - 10 -
